A regular meeting of the City Council of the City of Louisville was held on Wednesday, March 8, 2023 at 7:00 p.m. at City Hall. Present were Mayor Rod Petersen, Council Members Justin Barnes, Jamion Biesterfeld and Martyn Myers. Jerry McClun was absent. Also present were City Attorney Roger Johnson and guests. Mayor Petersen stated that the Open Meetings Act is posted at the rear of the room and a copy of all meeting materials is available with the clerk.
Notice of the regular meeting was given in advance thereof by posting in three (3) public places as shown by the certificate attached to these minutes. Notice was simultaneously given to all council members. Their acknowledgement of receipt of notice and the agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the public.
Mayor Petersen called the meeting to order and asked the Council to review the consent agenda. Biesterfeld moves, Barnes seconds to approve the consent agenda as revised. Roll call vote: ayes – Barnes, Biesterfeld, Myers; absent – McClun. Motion carried.
Josh Charvat, the new executive director for CCNEDC was present to introduce himself.
Kari Wockenfuss reported for the Care Center.
The annual library report was presented by Jennifer Rose.
Biesterfeld moves, Myers seconds to approve the bid from Gerst Painting, Inc. for the care center wall repair and paint project in the amount of $46,870.00. Roll call vote: ayes – Barnes, Biesterfeld, Myers; absent – McClun. Motion carried.
Biesterfeld moves, Barnes seconds to approve the Eide Bailly LLP agreement for employee retention tax credit services for LCC. Roll call vote: ayes – Barnes, Biesterfeld, Myers; absent – McClun. Motion carried.
Heather/Josh Ackman from Shortcake Sweets and Treats food truck asked for permission to set up on various days. The council agreed to a location and asked them to inform the clerk when they plan to come.
Marth Rowell was present to complain about the speed of drivers on Vine Street south of Highway 66 and asked for the council to consider speed bumps.
The Mayor Proclaimed March 16, 2023 as LPS High School Speech Team Day and wished them a successful state competition.
Barnes moves, Myers seconds to approve the agreement with Louisville Public Schools for use of the ball field and authorize the Mayor to execute. Roll call vote: ayes – Barnes, Biesterfeld, Myers; absent – McClun. Motion carried.
Mayor Petersen reported for street, water and sewer.
A written sheriff’s report was circulated. No report for fire/rescue.
An internal audit was conducted verifying checks to invoices by the council members.
Biesterfeld moves, Myers seconds to approve Resolution 23-03; signing of environmental services agreement with HDR for 6th St. Bridge Project. Roll call vote: ayes – Barnes, Biesterfeld, Myers; absent – McClun. Motion carried.
Biesterfeld moves, Barnes seconds to accept the resignation of Marty Myers from the city council. Roll call vote: ayes – Biesterfeld, Barnes, Petersen; abstain – Myers, absent – McClun. Motion carried.
Biesterfeld moves, Barnes seconds to declare a vacancy on the City Council caused by Marty Myers resignation and direct posting of notice of vacancy for balance of term; to December 2024. Roll call vote: ayes – Barnes, Biesterfeld, Petersen; absent – McClun. Motion carried.
Barnes moves, Biesterfeld seconds to schedule a special meeting for 6:55 p.m. on April 12, 2023 to fill the vacancy. Roll call vote: ayes – Barnes, Biesterfeld, Petersen; absent – McClun. Motion carried.
Biesterfeld moves, Barnes seconds to adjourn the meeting at 8:18 p.m. Roll call vote: ayes – Barnes, Biesterfeld, Petersen; absent – McClun. Motion carried.
